Terms and Conditions

Acceptance of our work and booking with us is also acceptance of our Terms and Conditions (T&Cs).  We reserve the right to add to and / or amend our T&Cs of trading without giving prior notice.  Current T&Cs are:

 

1.     Pricing

1.1.  The price for chimney sweeping will be advised at time of booking, aligned to details on our website and based on information you provide. Should we encounter any material differences on arrival, we reserve the right to requote for work required.

1.2.  In the course of our work, if we encounter any previously unknown issues that need further rectification, we will advise in advance of completing such work and any additional charges applicable.  Examples include unforeseen repair work, blockages, flue issues or excessive creosote build-up.

 

2.     Cancellation

2.1.  We appreciate that sometimes circumstances change beyond our customers’ control and cancellations may sometimes be necessary.  Should you wish to cancel or reschedule an order; you agree to give us as much notice as is reasonably practicable. However, if less than 24 hours is given, we reserve the right to charge 50% of the quoted price.

2.2.  If you cancel the order / booking with less than 12 hours’ notice we reserve the right to charge the full amount quoted.

2.3.  We reserve the right to charge a cancellation fee of up to the full quoted price in the event of being unable to complete the work due to no access possible (e.g. no-one at home) or appliance / fire still being live (i.e. hot).

2.4.  Such charges are in accordance with, and subject to, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

 

3.     Payment.

3.1.  Payment is due from you on completion of the services provided unless otherwise agreed.  Invoices must be paid within days allowed and as specified on invoicing.

3.2.  If we do not receive payment from you on orders, we reserve the right to cancel orders and or repossess. All parts remain property of Hart & Kohl Ltd until payment is made in full.

3.3.  We do not send payment receipts or booking confirmation by post. Payment confirmation will be sent to the email address you provided.

3.4.  Accepted methods of payments are Cash, Credit or Debit Card and Bacs.

3.5.  Payments not settled within days allowed may attract a charge of 2% per annum above Bank of England Base Rate.

 

4.     Your Obligation

4.1.  You agree to ensure that the information you supply for your booking / order with us is complete, accurate and up to date.

4.2.  You will notify us immediately you become aware of any inaccuracy contained within your booking / order.

4.3.  Pre-arranged appointments with the chimney sweep are taken on the understanding that an adult will be present at the appointment time. If we are unable to obtain access to the premises this will be considered a cancellation and previously stated cancellation fees will apply.

4.4.  You are responsible to keep pets and children supervised within the property throughout our visit. They should remain in a separate room for the duration of our visit and have a designated responsible person(s) with them at all times. We cannot accept liability for loss, injury or damage arising from failure to do so.

4.5.  The sweeping process involves multiple trips to and from our vehicle. This means access doors sometimes remain open. It is the responsibility of the customer or their designated person to ensure all valuables are secure and away from the work route/area.

4.6.  Debris, soot and waste incurred during the sweeping process will be left with you for disposal with your household waste. We do not remove any waste from the property.

 

5.     Liability

5.1.  Advice and guidance given as part of the service provided by Hart & Kohl Ltd is given in good faith, based on accessible visual inspection and information provided.

5.2.  It will be assumed that unless otherwise advised by the customer or evident on inspection that the appliance, flue, terminals and all component parts are correctly and safely installed and are in a fit state to be swept.  We cannot be held responsible for chimney problems that occur during sweeping that were not evident beforehand or not advised to us if known by the customer.

5.3.  All reasonable steps are taken to prevent damage to the customer’s property however we cannot be held responsible for actual or consequential damage arising through poor installation or poorly maintained, deteriorated, inappropriate or broken fixtures and fittings such as chimney pots and stacks, cowls, flues, liners or fireplaces.

5.4.  The certificates provided are not a guarantee or warranty that any fireplace, heating appliance, boiler, flue or chimney stack is safe. Hart & Kohl Ltd cannot warrant that there are no potential defects in the flue or your chimney arising from fair wear and tear, wilful damage, accident, negligence by you or any third party without special instruction for investigation.

5.5.  Hart & Kohl Ltd cannot warrant the failure to use the appliance etc as recommended by the manufacturer of the appliance, heating appliance, boiler or flue, failure to follow the manufacturers instruction, or any alterations or repairs carried out by you or any third party are not covered by ourselves.

 

6.     Complaints

6.1.  Any complaints regarding our goods or services must be made within 10 days of the services or goods being delivered.

6.2.  Any complaint must first be made to Hart & Kohl Ltd. If no satisfactory result is made within a reasonable time, it is suggested that you contact the Trade Association listed on your sweeping certificate to take your complaint further.

 

7.     GDPR (General Data Protection Regulation) 2018

7.1.  When a booking is made you understand that we will keep your house and contact details on file, and you give us permission to contact you when your chimney becomes due for sweeping.

7.2.  The use of our services is acceptance of these terms and signatures are not required to prove acceptance.

 

8.     E & OE. 

Every effort has been made to ensure the terms and conditions are as up to date as possible, but we do accept any errors and omissions are excepted.
